Terms of Service

1. Acceptance
By creating an account, paying a subscription, or otherwise using QSimHealth (the "Service"), you agree to these Terms. If you don't agree, don't use the Service. The Service is owned and operated by ChiAha, LLC ("ChiAha", "we", "us"). Contact: queuesim@chiaha.com.
2. The Service
QSimHealth is a healthcare staffing decision tool. It runs discrete-event simulations of provider schedules against arrival patterns and treatment-time distributions. It is a planning aid, not clinical software.
3. What the Service is NOT
- Not medical advice or clinical decision support. Outputs are scenario projections based on inputs you provide. Use them as one input to operational decisions, alongside professional judgment, your facility's data, and applicable regulations
- Not a HIPAA-regulated system. The Service does not collect, store, or process protected health information (PHI). Don't enter patient identifiers; if you do, you bear responsibility for that disclosure
- Not a substitute for professional advice. Staffing, payroll, and labor decisions remain yours and your organization's
4. Account & access
- You're responsible for keeping your sign-in account secure. We use Google or Microsoft OAuth — there's no QSimHealth password to leak, but a compromised Google/Microsoft account compromises access here
- One account per individual user. Site-license / institutional terms are negotiated separately under our Academic Institution and Enterprise tiers
- We may suspend accounts that abuse the service (rate-limit attacks, attempts to circumvent caps, sharing credentials at scale)
5. Tiers and pricing
- Academic Individual — Free, .edu / equivalent academic email. Full simulator access, no commercial use
- Academic Institution — Site license. Pricing on request
- Professional — $68/month. Single-facility license. 10-day free trial; subscription billed via FastSpring after the trial concludes if you upgrade
- Enterprise — Multi-facility / health-system / white-label terms negotiated separately
Prices may change with 30 days' notice to active subscribers. Existing billing periods aren't repriced retroactively.
6. Trial
The Professional tier includes a 10-day free trial. You don't need a credit card to start the trial — just verify your email. If you don't subscribe within 10 days of signup, your access ends and you're prompted to upgrade. Re-verifying or creating a second account to extend the trial isn't permitted; if you need genuine extra evaluation time, email us.
7. Billing & cancellation
- Subscriptions are processed by FastSpring (our merchant of record). Their terms govern the payment relationship
- You may cancel at any time via your FastSpring customer portal — the link is in your order confirmation email, or visit /account while signed in
- Cancellation takes effect at the end of the current billing period. We don't pro-rate partial months
- Refunds: handled by FastSpring per their refund policy. We don't issue refunds outside FastSpring's process
8. Acceptable use
- Don't reverse-engineer, scrape at scale, or attempt to extract our proprietary models
- Don't use the Service to make automated medical decisions affecting patient care
- Don't enter PHI, names of patients, or anything that identifies a real person
- Don't share your sign-in across multiple individuals — one human per account
- Respect rate limits; don't try to circumvent the trial-access gate
9. Intellectual property
QSimHealth's software, simulation engine, UI, and content are owned by ChiAha. You receive a non-exclusive, non-transferable license to use the Service for the duration of your subscription. The scenarios you model and the inputs you enter remain yours.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SIMULATION OUTPUTS ARE PROJECTIONS BASED ON INPUTS; THEY ARE NOT GUARANTEES OF ANY OPERATIONAL OUTCOME.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CHIAHA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. CHIAHA'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Termination
You may terminate by canceling your subscription. We may terminate for material breach of these Terms (e.g. abuse of the Service, attempted compromise of the platform), with reasonable notice except where the breach is severe. On termination we will retain your billing records as legally required and delete other personal data within 30 days of your request.
13. Changes to these Terms
We may update these Terms periodically. Material changes will be communicated to active subscribers at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Knox County, Tennessee, and you consent to that jurisdiction.
